Judge Lifts C-Murder's House Arrest

-Murder has been released from home confinement after being accused of violating the conditions of his house arrest numerous times.
Judge Martha Sassone of the 24th Judicial District Court denied a request on Thursday (July 13) to jail the embattled rapper after prosecutors and witnesses alleged that C-Murder (born Corey Miller) was frequently out of range of his home detention monitoring system.

According to the New Orleans Times Picuyane, Sassone said she was confident that Miller had not violated the conditions of house arrest.

The judge's decision allows Miller to travel between the Jefferson and Orleans parishes.

While Miller will no longer be confined to home-monitoring, his release will still be closely supervised. According to court records, the rapper must be home between the hours of 10 p.m. to 6 a.m., and visitors to his residence have been restricted. He is also banned from drinking and going to bars.

Miller had been incarcerated since 2002 after being convicted of second-degree murder in the shooting death of 16-year-old Steven Thomas.

Thomas was shot in the chest after an argument inside of the now defunct Platinum Club in Jefferson Parish, Louisiana, in January 2002. The rapper was convicted in September 2003 and sentenced to a mandatory life sentence.

He appealed the case in 2004, after discovering prosecutors had expunged the criminal records of some of their witnesses and withheld evidence from Miller's defense team.

In 2004, the original trial judge, Judge Martha Sassone ordered a new trial for Miller in light of the new evidence. In March 2005, the 5th Circuit Court of Appeal struck down Sassone's ruling and upheld Miller's second-degree murder conviction.

Miller appealed the ruling in February, and on March 10 the Louisiana Supreme Court overturned Miller's murder conviction and ordered a new trial.

It is now up to prosecutors to decide if they want to take Miller to trial again.

C-Murder Placed Back on House Arrest

Corey “C-Murder” Miller was ordered back on house arrest on Thursday (August 17) by the same judge who had released him from the program just a month earlier, according to the New Orleans Times-Picayune...

The ruling comes two days after a state appeals court found that Judge Martha Sassone improperly released him from the program on July 13 when she imposed a 10 p.m. to 6 a.m. curfew and ordered him to stay within the Jefferson and Orleans parishes. Although the three-judge appeals panel said it found “inadequate support” for prosecutors allegations that Sassone abused her judicial discretion, they believed that she should have given the state a chance to argue against her decision prior to releasing Miller from home incarceration. In response to the appellate court’s ruling, Judge Sassone issued a one-page order stating that “Corey Miller is to be placed on complete home incarceration and is further ordered that he is not allowed to leave his residence at any time.” In a separate order also filed on Thursday, Sassone reinstated a gag order on all parties involved in the case that also extends to the home incarceration program.

While awaiting a retrial for the 2002 shooting of a teenager, Corey "C. Miller" Miller will release TRU Story: Continued, a special new CD/DVD limited-edition release.

The CD/DVD combo includes the original album, The Truest S*** I Ever Said, as well as, 5 previously unreleased studio tracks.

Additionally, the new release also contains a 60-minute DVD documentary hosted by B.G. that features videos and behind-the-scenes footage.

Directed by New Orleans native Will Horton, the DVD is highlighted with "Y'all Heard Of Me," the controversial 2005 video that Miller shot while incarcerated inside a New Orleans jail.

Miller was sentenced to full time house arrest last month by Louisiana state Judge Martha Sassone, after he allegedly attended a Hurricane Katrina documentary premiere in New Orleans, after his 10 PM curfew.

Miller was convicted of second-degree murder in Jan. 2002 for the shooting death of 16-year-old Steven Thomas, after an argument inside of the now defunct Platinum Club in Jefferson Parish, Louisiana.

In Feb. 2006, the Louisiana Supreme Court overturned Miller's murder conviction and ordered a new trial, after it was discovered that prosecutors had withheld evidence from Miller's defense team.

A date has not been set for the retrial of the rapper.

C. Miller's TRU Story: Continued is set to arrive in stores on October 17 via Koch Records.

C-Murder News

A rapper under house arrest can be photographed at his home but cannot give interviews to promote his latest album, says the judge supervising his case.
Interviews would violate a gag order imposed to keep pretrial publicity to a minimum, State District Judge Martha Sassone told Corey Miller, who used the stage name C-Murder before his arrest on a second-degree murder charge.

"I guess the music will have to speak for itself," she said. "Capitol Records will have to find another way to advertise it..."

She has ordered Miller, 35, to stay at his house in Kenner until his trial, scheduled Feb. 26, on a charge accusing him of killing Steve Thomas, 16, on Jan. 12, 2002, at a now-closed club in Harvey.

Miller was convicted of second-degree murder but won a new trial in March when the state Supreme Court affirmed Sassone's ruling that prosecutors withheld criminal background information on their witnesses from Miller's defense attorneys.

House arrest is a condition of Miller's $500,000 bond.

Attorney Ron Rakosky asked Sassone on Monday for permission to promote the album, which he did not identify by title. Miller depends on his music to support his three children, pay for his legal defense and renovate his grandmother's New Orleans home, flooded by Hurricane Katrina, the attorney said.

Assistant District Attorney Roger Jordan objected that the judge let Miller out on bond only to help prepare his defense.

Miller is seeking a change of venue for his trial because of pretrial reports about his case. Video, photography sessions and interviews would only intensify that, and Thomas' family and the community would find it improper, Jordan said.

"I don't have a problem with the photographs," as long as they're done at his home, Rakosky is present and she knows in advance the photographer's name, Sassone said.

"There'll be no interviews, no music videos," she said.

Sassone also agreed to let Miller, currently under orders to stay inside his house, into his back yard to play with his children. "I would like for him to spend time with his kids," she said.
